These terms and conditions outline the rules and regulations for the use of the XPAT System. By using this system you accept these terms and conditions in full. Do not continue to use the XPAT System if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “XPAT System” refers to the XPAT System mobile app and related websites, i.e. https://xpat.egov.mv/ , “Client”, “You” and “Your” refers to you, the person accessing XPAT System and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Ministry (Homeland Security and Technology, Maldives). “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the processes offered to the Client in order to meet the user needs. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

If you are an individual accessing or using the website on behalf of, or for the benefit of, any corporation, partnership or other entity with which you are associated (an “Organization”), then you are agreeing to these Terms on behalf of yourself and such Organizations, and you represent and warrant that you have the legal authority to bind such Organizations to these Terms.

References to “you” and “your” in these Terms will refer to both the individual using the website and to any such Organization.

We reserve the right at any time and in its sole discretion to remove all access to our apps or Websites. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuing to access our app and Web site, you agree to be bound to and abide by these linking terms and conditions.

This system may be used to gain foreign employment in the Maldives. Users may register their work site addresses, apply for work permits, expat quotas and other related requests involving expatriate affairs in Maldives.

Users have the right to submit, update and request removal of some relevant information regarding foreign employment catered within the system.

The XPAT System may be used to conduct all payment related activities including (but not limited to) work permit fees, quota payments, work visa fee payments and fines.

Unless otherwise stated, the Ministry of Homeland Security and Technology of the Maldives own the intellectual property rights for all material on XPAT System. All intellectual property rights are reserved. You may view and/or print pages from XPAT System for your own personal use subject to restrictions set in these terms and conditions. You must not:

Republish material from XPAT System; Sell, rent or sub-license material from XPAT System; Reproduce; duplicate or copy material from XPAT System; Redistribute content from XPAT System (unless content is specifically made for redistribution).

XPAT System will have the full rights (but has no obligation to) screen, monitor, evaluate and remove any Submitted Materials at any time and for any reason, or analyze your access to and use of the website. We may disclose information regarding your access to and uses and the circumstances surrounding such access and use, to any authorized party for any reason or purpose.

For clarity, certain information that you provide to XPAT System through the website may also be governed by XPAT System’s Privacy Policy. You represent and warrant that any information you provide in connection with the website are and will remain accurate and complete, and that you will maintain and update such information as needed.

No use of XPAT System’s logo, the Ministry’s logo, or other artwork will be allowed for linking absent a trademark/license agreement.

Without prior approval and express written permission, you may not create frames around our Web pages and forms or use other techniques that alter in any way the visual presentation or appearance of our apps or Web sites.

If you find any information on our Web site or app objectionable for any reason, you may contact us about this. We will consider requests to remove information but will have no obligation to do so or to respond directly to you.

Whilst we endeavor to ensure that the information on XPAT System is correct and up to date, we do not warrant its completeness or accuracy; nor do we commit to ensuring that XPAT System remains available or that the material on the app is kept up to date.

We shall have no responsibility or liability for any content appearing on XPAT System. You agree to indemnify and defend us against all claims arising out of or based upon XPAT System.

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and app and the use of this website and app (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will: limit or exclude your liability for fraud or fraudulent misrepresentation; limit any of your liabilities in any way that is not permitted under applicable law; or exclude any of your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent that the website and app and the information and services on the website and app are provided, we will not be liable for any loss or damage of any nature.
